Description: 

Since the rise of the #MeToo movement, there has been a significant increase in defamation lawsuits filed by individuals accused of sexual misconduct against their accusers, in many instances as a means of retaliation, or as a silencing tactic against survivors seeking to express their truth. On February 25, Ad Idem will host a CLE Webinar to discuss the rise of these retaliatory defamation suits, and how these suits have been playing out in courts across the country. In this program, Victoria Burke will also share her legislative advocacy on this issue, having herself drafted and proposed a bill which became California AB 933, which sought to allow survivors of sexual assault, harassment, or discrimination to speak without the fear of weaponized defamation lawsuits used to silence their voices. AB 933 was signed into law in 2023. Victoria is now working to get this legislation passed in other states, making progress in New York, Maryland, Oregon, Washington, North Dakota, Kansas, Texas, Georgia, Ohio, Wisconsin, Michigan, New Hampshire, Maine, Rhode Island, Connecticut, Pennsylvania and Virginia.
